Translation for convenience. The official version of these documents is the Brazilian Portuguese one. In case of any discrepancy or conflict of interpretation between versions, the Brazilian Portuguese version prevails in full.
By purchasing or using any MagnoHost service, you declare that you have read and fully agree to the documents below.
Terms of Service
The rules that apply when you buy and use any MagnoHost service.
1.0 Acceptance of the terms
By using MagnoHost services, you agree to these Terms of Service. If you do not agree to these terms, please do not use our services.
1.1 Registration and security
As part of the registration process, you will create a password and an account. You are responsible for keeping your password and your account confidential, and you are fully responsible for all activity that takes place under your password or account.
1.2 Use of the service
You agree to use our services in a lawful and ethical manner, and not to employ them for illegal, fraudulent or malicious activities, or any other activity that may harm the operation of our systems or the security of third parties.
1.3 Payment
Details about prices and payment plans are available on our website. Payment is required in advance for all services, and approval time may vary according to the payment method chosen. Any additional fees or extra costs, such as taxes or bank charges, will be detailed at the time of purchase.
1.4 Uptime SLA
MagnoHost undertakes to provide 99.7% uptime for all of our services. Should downtime exceed 0.3% of the total monthly service time, MagnoHost will offer compensation equivalent to up to 2 times the downtime measured on the service.
1.5 Limitation of liability
MagnoHost will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages resulting from the use of or the inability to use our services. MagnoHost will not be liable for failures that occur due to external factors, such as problems with the customer network, or failures in hardware or software not supplied by MagnoHost.
1.6 Indemnity
You agree to indemnify and hold MagnoHost harmless from any claim, loss, liability, cost or damage arising from legal actions or demands made by third parties due to your use of the service.
1.7 Dispute resolution
Any dispute relating to these Terms of Service will be governed by the laws of the Federative Republic of Brazil, without regard to any conflicting choice of law provisions.
1.8 Changes to the terms
MagnoHost reserves the right to modify these Terms of Service at any time. Changes take effect immediately upon publication on our website. We recommend that you review the Terms regularly to make sure you are aware of any changes.
1.9 Official language
These Terms and the other documents on this page were drafted in Brazilian Portuguese, which is their official version. The English and Spanish versions are translations made available only to aid understanding and have no legal effect of their own. In the event of any discrepancy, omission or conflict of interpretation between the versions, the Brazilian Portuguese version prevails in full.

1.0 Information we collect
We may collect personal information that you provide to us when registering, such as your name, email address, payment details, and other information necessary to provide our services.
1.1 How we use your information
We use your personal information to provide and improve our services, process payments and manage your subscriptions. We also use your data to communicate with you about updates, changes and promotions related to our services. In addition, we may use your information to comply with legal and regulatory obligations, as necessary.

We do not share your personal information with third parties, except where this is necessary to provide our services, such as when we work with payment processors or infrastructure partners. We may also share your information when required by law or by the competent authorities, or in the event of a merger, acquisition or sale of company assets.
1.3 Security

Special Clauses
Specific rules on network use, backups and responsibility for data.
1.0 Misuse of the service
MagnoHost reserves the right to suspend or terminate any service that is used for unlawful or fraudulent purposes, or that violates Brazilian law, for example: piracy activities; denial of service (DDoS) attacks; sending SPAM; any other behaviour that harms the network, servers or systems of third parties.
1.1 Force majeure
MagnoHost will not be liable for failures or interruptions in the services caused by force majeure events, including but not limited to natural disasters, cyber attacks, electrical power supply failures, acts of terrorism or any other situation beyond the reasonable control of the company.
1.2 Definition of "Service"
For the purposes of this document, the service refers to the provision of hosting, technical support, server management and any other service offered by MagnoHost in its portfolio.
1.3 Backups and responsibility for data
MagnoHost provides automatic backups as a courtesy, with no guarantee of integrity, frequency or availability. This feature does not replace the customer responsibility to keep backup copies of their own data. The customer must keep up-to-date backups stored on their own. If greater security and a restore guarantee are required, we recommend purchasing the additional managed backup service offered by MagnoHost. MagnoHost is not responsible for data loss resulting from failures, accidental deletions, hardware or software problems, or actions of the customer, except where the managed backup service is active and in contractual compliance.
1.4 Service retention after expiry
Once the renewal date has passed and payment has not been made, MagnoHost guarantees the preservation of the service and of the data stored in it for up to 7 (seven) calendar days. During this period, the customer may settle the payment and resume use with no loss of content. After this period, the service and all associated data, including backups, may be deleted automatically, permanently and without prior notice, at any time, with no possibility of recovery. It is the customer responsibility to keep their own copies of their data before expiry, as set out in clause 1.3.
1.5 Network use policy and traffic limit
The services are intended exclusively for the purposes contracted, and use of the infrastructure for intensive, continuous or disproportionate network activity is prohibited (tunneling, proxy, VPN, unauthorised CDN, traffic relaying, large-scale streaming). A maximum limit of 30 TB of traffic per month (upload + download) is established. Any excess may, at the discretion of MagnoHost, be subject to bandwidth throttling, generate an additional charge or result in suspension of the service. MagnoHost reserves the right to monitor traffic patterns and to intervene preventively whenever it identifies use that compromises the stability of the infrastructure.
1.6 Final provisions
These Terms of Service are governed by the laws of the Federative Republic of Brazil. Any dispute arising from the interpretation or performance of these Terms will be settled in the courts of the city of São Paulo, State of São Paulo, with express waiver of any other, however privileged it may be.

Refund Policy
Our guidelines on refunds for services.
1.0 Cancellation
You may cancel your service at any time in your client area. Every cancellation request is processed immediately.
1.1 Right of withdrawal
You may request the cancellation of a service you have purchased within up to 7 (seven) calendar days of the purchase.
1.2 Processing of refunds
To request a refund, the customer must open a ticket in the client area using the billing department, which is the only official channel for this type of request. Requests made through other contact channels, such as Discord or WhatsApp, will not be considered. The ticket must state: the reason for the request; bank details for the return of the amount; additional documentation, if necessary, to confirm identity and prevent fraud. MagnoHost undertakes to start the refund process within 72 hours of a valid request and to complete it within a maximum of 10 calendar days.
1.3 Limits to the right of withdrawal
The right of withdrawal will not apply when: the service has been activated and used in part or in full (Article 51, IV of the Brazilian Consumer Protection Code, CDC); in the case of dedicated servers, as these cannot be refunded; the customer failed to provide the information needed for activation (Article 49 of the CDC); upon renewing the service, the customer agrees that the amount paid will not be refunded, except in the event of a proven failure; MagnoHost will not issue multiple refunds to the same customer within 90 days of a previous refund.
